IN COURT: Cases heard at Central Devon Magistrates' Court

Paul Fealy , 48, of Hurst Avenue, Exeter, pleaded guilty to driving in Bovemoors Lane on January 14 when the proportion of alcohol in his breath was 42mcg in 100ml, exceeding the legal limit. He was fined £550 with a victim surcharge of £55 and costs of £85. He was also disqualified from driving for 12 months which can be reduced by 12 weeks if he satisfactorily completes an approved driving course.

Luke Marks , 21, of Exwick Road, Exeter, admitted using threatening, abusive or insulting words and behaviour within the hearing or sight of someone likely to be caused harassment, alarm or distress on January 13. He received a 12-month conditional discharge and will have to pay a £15 victim surcharge. There was no order for costs.

Rosemary Kirkham , 48, of St David's Hill, Exeter, admitted being drunk and disorderly in the accident and emergency department at the Royal Devon & Exeter Hospital on January 12. She received a six-month conditional discharge with a victim surcharge of £15 and no order for costs.

Graham Muirhead , 32, of Smythen Street, Exeter, has been made the subject of a community order after he pleaded guilty to being in Fore Street on January 11 which he was carrying a bill hook without good reason or lawful authority. The order will see him subject to a curfew for six weeks. He will have to pay a £60 victim surcharge and the bill hook will be destroyed. There was no order for costs and he was detained in the courthouse for a short period in lieu of the financial penalty.

Timothy Wakeley , 51, of Prince Charles Road, Exeter, pleaded guilty to stealing a joint of gammon worth £10 from the Co-op on January 3. He also admitted stealing two bottles of wine from the same store, worth £10.48, on January 7. He was fined a total of £70 with a £20 victim surcharge but was detained in the courthouse for a short period in lieu of this. There was no order for costs.

Sam Weatherill , 27, of Guinness Lane, Exeter, admitted damaging a window without lawful excuse on New Year's Day. The value of damage was estimated at £150. He will have to pay that amount in compensation to the owner of the property and was also made the subject of a community order. This took into account his additional guilty pleas to assaulting two men and one woman on the same date. As part of this he will have to participate in a low intensity alcohol programme and carry out 40 hours of unpaid work. There was also an order for a victim surcharge of £60 and costs of £85.

Matthew McClay , 21, of Meadow Way, Exeter, assaulted a woman be beating her on November 28 last year and again on December 13. He pleaded guilty and a community order was made which has a supervision requirement. He will also have to pay a £60 victim surcharge and costs of £85. No compensation was ordered as the assaults occurred within a domestic setting and magistrates heard the parties are reconciling with the intent of continuing their relationship.

Thomas Brook , 20, of no fixed abode, and Lee Cockram, 28, of Bowden Hill, Crediton, jointly admitted that they entered a dwelling in Crediton as trespassers and stole a television with a value of £400. Both received community orders. Brook's has a requirement that he must participate in the Thinking Skills programme and undergo supervision. Cockram's only has a supervision requirement. They will also both have to pay £50 in compensation to the property's owner and pay a victim surcharge of £60.

Jake Cornish , 18, of King Stephen Close, Exeter, pleaded guilty to being in possession of 27.56g of cannabis, a Class B drug, with intent to supply on January 29. A community order was made which will see him have to carry out 80 hours of unpaid work within the next 12 months. He will also have to pay a victim surcharge of £60 and there was no order for costs.

Mark Hall , 20, of Hill Barton Lane, Exeter, failed to give information relating to the driver of a vehicle who alleged to have been guilty of an offence on September 12 last year. He was fined £180 with a victim surcharge of £15 and costs of £60. His licence was also endorsed with six points.

Robert Lockyear , 28, of Hillcrest, Cullompton, pleaded guilty to driving in Exeter on September 14 last year when he was using a mobile phone. He was fined £60 with a £15 victim surcharge and his licence was endorsed with three points.

Nathan Murray , 23, of York Terrace, Exeter, stole three joints of meat worth £44.80 from Marks and Spencer on January 30. He pleaded guilty and was fined £100 with a victim surcharge of £20. But he was detained the courthouse for a short period in lieu of the financial penalty.

Thomas Kremer , 82, of Widworthy near Honiton, changed his plea and admitted driving without due care and attention on the A35 near Wilmington on June 23. He was fined £300 with a victim surcharge of £15 and costs of £85. His licence was also endorsed with six points. Charges relating to failing to stop and give his name and address after an accident occurred in which damage was caused to another vehicle were dismissed. He did not face a separate penalty for driving on the same date in a vehicle which had no MOT certificate.

Nathan Murray , 25, of no fixed abode pleaded guilty to being in possession of a quantity of diazepam, a Class C drug, on April 8 last year. He received a 12-month conditional discharge with no order for costs due to his limited means. The drugs will be destroyed.

John Fairer , 26, of Ludwell Lane, Exeter, was sent to prison for seven days after pleading guilty to interfering with a number of cars which were parked in Looe Road on January 28 with the intention that an offence of theft should be committed. Magistrates deemed the offence to be serious because it was committed while he was on licence, it constituted the breach of a conditional discharge which he received for offences of theft, the offence was planned, and because of his previous convictions. There was no order for costs or compensation due to the custodial penalty.

Samuel Cox , 29, of Lancelot Road, Exeter, was found guilty of assaulting a man by beating him on April 6, last year, having denied being involved in the offence. A community order was made which will see him have to carry out 120 hours of unpaid work within the next 12 months. He will also have to pay £100 in compensation to his victim and £100 costs.

Geraldine Shaw , 47, of Collerton Way, Exmouth, has received a six-month conditional discharge after pleading guilty to being drunk and disorderly in the town on January 17. She will also have to pay a £15 victim surcharge but there was no order for costs or compensation due to her limited means.

atrick Wallace , 45, of no fixed abode, admitted destroying a window at Sainsbury's to the value of £2,000 without lawful excuse on February 5. He further admitted that the act was committed while he was subject to a conditional discharge for six months which was imposed on January 3 for an offence of shoplifting. He was sent to prison for eight weeks. Magistrates deemed the offence to be serious because of the level of damage caused, that it was committed while subject to a conditional discharge and that he has indicated an unwillingness to cooperate with probation. There was no order for costs or compensation due to the custodial penalty.

Claire Hottinger , 26, of Williams Avenue, Exeter, failed to provide a specimen for analysis when required to do so as part of an investigation into whether a criminal offence had been committed on January 18. She pleaded guilty and a community order was made which will see her have to participate in an alcohol specified activity for 12 says and undergo supervision. She was also banned form driving for three years which can be reduced by nine months if she satisfactorily completes a course approved by the secretary of state.

Stefan Thorrington , 22, of Binford Close, Exeter, dishonestly undertook in the retention, disposal or realisation of stolen goods, namely 560kg of alloy wheels, knowing or believing the same to be stolen goods on December 4 last year. He pleaded guilty to this and to using a van when he had no insurance and using a van otherwise than in accordance with his licence on the same date. He received a £100 fine and a community order which will see him have to carry out 80 hours of unpaid work within the next 12 months. He will also have to pay a victim surcharge of £60. There was no order for costs due to his limited means.
